Is anyone starting to feel slightly sorry for Sheff Utd? - I am
Initially when they went to court I honestly wished they had left it and concentrated on coming straight back up. I thought they had no chance as no one would be that silly to rip up a contract and just think that they own a player worth £30m+ surely there must of been some agreement somewhere....
Now Man U want to buy him and no one knows where the money needs to go. They pay West Ham, but apparently the Kia guy owns the economic rights, however they can't pay him as that would show that he still owned the player and surely would leave no dispute that he was a third party player.
The FA have made a complete mess of this. With the money in the premier league and the fact Football Clubs are run like businesses, surely they need a more business like body to act with the FA to ensure that they write the rules.
Something still smells fishy in this whole saga and it will be interested to see how it is resolved

I'd like to congratulate West Ham for getting away with the biggest, most obvious case of cheating since Maradonna's hand of god.
If there was any justice they would finish bottom next season, but i can't see it with the 'legal' signings they've made this summer tdwn:

To be honest, If Sheffield United had gained enough points to stay in the Premiership then they wouldn't this problem.
Like it or not, West Ham have been punished in way that was deemed appropriate by the premier league and the commision set up to view the punishment.
As far as i'm concerned that matter is closed.

If some guy owns this players economic rights, then West Ham have payed a 3rd party for the player, which isn't allowed. A £5.5 million fine to West Ham is nothing

The Premier League and the FA have said the transfer is now ok, so West Ham hold Tevez's registration so the money should go to them! If West Ham don't have Tevez's documents then how did teh FA reach their verdict? And if tehy do own the player then all monies should go to them!

Thats what my Grandad who supports WHU says and says its all their own fault, but ultimatley over 38 games West Ham finished 2 points higher and with a big involvement from Mr. Tevez who they (and the FA) believe was playing illegally. By the time he came into the run of form however his contract was made legitimate.
The way i get it is that a club is allowed to have a third party ownership, but said 3rd party is not allowed to have any involvement in the player and is not allowed to say whether or not he can play.
Kia Jor... had a clause (which WHUFC didn't tell the premier league/ FA about) that they could leave in January if a bid of under a million pounds came in for either player, which thus meant the third party was getting involved in team affairs.
Currently Kia Jor... owns the economic rights and WHUFC own the playing rights so he cant move to Man U unless WHU cancel the playing contract and may ask for comphensation from either Man U or Kia Jor....
As far as our friends in South Yorkshire are concerned i dont know why they think there should be a points deduction as no president in such a case has been set.
West Ham have been punished by the Premier League so that should be the end of it, but it all comes up again thanks to Man U trying to sign him.

West Hams new board were stuffed like a kipper by the outgoing mob and should IMHO of not been fined at all...
They are the blameless ones here..
The FA and those old board members along with Tevez's agents are the ones who should be done...
They allowed the transfer to go through and the player to move...Not the Icelandic Gollomesque bloke at the helm...
Sheff utd have a decent case dont get me wrong and i wish em well on getting as much as they can...
Alan Sugar went to court didnt he to stop some charge by the FA which stemmed from a previous owner and he won...
Hating West Ham is laughable though to those who now think signing a player is worse than throwing yourself into admin to clear your debts off just cos you can...

The point here is that the PL accepted WHU's pledge that they, and they alone, held Tevez's registration and that is why he was free to play the last part of the season.
Now that ManUre are trying to buy him, suddenly WHU no longer seem to hold his registration, making a total mockery of the original disciplinary panel and the arbitration last week.

I thought that the case of Jermaine Darlington was being cited as such.
If I have my facts correct, AFC Wimbledon were chucked out of two cups, deducted 18 points and given a fine. Their crime? Fielding an ineligible player through no fault of their own.

Why hasn't the same thing been brought up about Mascareno(?) at Liverpool where Liverpool were allowed to buy him after FIFA/UEFA/Whoever allowed special dispensation for a player to play for 3 clubs in one year. The Ryman league had already agreed with all it's clubs including AFC Wimbledon that the club would be deducted 3 points for each game the ineligible player played in (ie. 6 league games).
This was over the international clearance of the player through the welsh FA as cardiff was his last club (stupid i know!)
Tevez had received international clearance and also was eligible to play so the two 'offences' are not specifically the same.
The premier league have an agreement for the disciplinary committee to decide on punishments. On this occasion it was decided to fine them. There was nothing in their agreement with their clubs to say that they had to deduct points.

The ones who couldn't take it on the chin will be all the JCL's who know **** all.
The whole season shouldn't just rely on one game. It's over the 38 so any team that finds themselves in any position have done so because of their performance over the season. That's why Blackburn deserved the title in 95, Same with Arsenal and Chelsea in recent years.

It's a dodgy, dirty world at the top. Even if Tevez does sign and it is given the all clear, they will be some murky goings on behind the scene.

Would they have complained had they stayed up? It still seems a case of sour grapes. They just seem to be spending more and more money on this which i don't think they'll win.
Why don't they just put it to bed and get on with it.
It's the Premier League and the FA that need sorting out from top to bottom.

When West Ham were found guilty (and fined £5,500,000) they had to re-sign the players on new contracts, and they only Tevez took on/was offered a new legal contract by West Ham, so Mascerano was able to move to Liverpool. (I think;) )

When Liverpool signed Mascerano, that's when all the contract stuff started coming up with Teves. Liverpool informed the Premier League all was not well with the Mascerano contract and Teves' is/was the same. West Ham then said they had severed all ties with the 3rd party in about March I think to enable Teves to keep on playing for the rest of the season. They were then fined as we all know but now it seems it's all change again. This sort of **** kind of makes me glad that we're not up there in the top league. It's just not proper football!
